 High Court Stays ‘Troublemaker’ List

 Sanchita chatterjee: Just 24 hours prior to the first phase of voting, the Calcutta High Court issued an interim stay on the list of ‘troublemakers’—or individuals deemed likely to cause disturbances—compiled by the Election Commission. Consequently, approximately 800 individuals named in the list received significant relief right on the eve of the elections. A Division Bench comprising Chief Justice Sujoy Pal and Justice Parthasarathi Sen explicitly stated that, in accordance with Articles 21 and 22 of the Constitution, no individual's liberty may be infringed upon except through due process of law. One cannot be indiscriminately branded as a ‘troublemaker.’ The operation of this list shall remain suspended until the coming month of June. While the police remain free to take action against criminal offenders, such measures must be undertaken on the basis of specific, concrete information—not merely by virtue of an individual's inclusion in this list.

Trinamool MP Kalyan Banerjee had contended that the term ‘troublemaker’ holds no legal standing and that the list constitutes nothing more than an attempt to malign political leaders.


Representing the State Government, the Advocate General also voiced opposition to the list. Ultimately, raising questions regarding the Election Commission's legal jurisdiction in this matter, the Court has directed the Commission to submit an affidavit within four weeks.
