KMC issues notice to demolish two houses of Abhishek Banerjee within 7 days

The Kolkata Municipal Corporation has issued notices to a total of 17 properties belonging to Trinamool Congress All India General Secretary and MP Abhishek Banerjee for illegal construction. The most notable of these are his residence 'Shantiniketan' on Harish Mukherjee Road in South Kolkata and his house at 121 Kalighat Road. 


What is the gist of the notice? 

These notices have been issued under Section 400(1) of the KMC Act, 1980. The municipality alleges that several parts of the two houses have been built outside the approved design or Sanctioned Building Plan. That is, the plan for which permission was passed and the construction of the house was obtained, is different from the actual construction. 


Which two houses are on the scanner? 

 Shantiniketan: Abhishek Banerjee's own residence located on Harish Mukherjee Road. 

121 Kalighat Road: This house is registered in the name of Abhishek's mother Lata Banerjee. 


The building department of KMC has identified the non-designated parts of both the houses. 


Time limit and next steps 

The notice clearly states that the property owners will have to demolish the illegal parts on their own initiative within seven days. If it is not done within the specified time limit, the Kolkata Municipality will demolish that part itself. Not only that, it has been informed that the cost of demolition will also be recovered from the landlord. 


Abhishek Banerjee's reaction 

After receiving the notice, Abhishek Banerjee gave a strong reaction. He said, "Demolish the house, but I will not bow my head". The entire incident is being seen as political vendetta by the Trinamool Congress.  The party says that the administration is being used to pressure the opposition parties. 


Reaction in political circles 

State politics is already in full swing around this notice. Trinamool alleged that before and after the Lok Sabha elections, along with the central agency, efforts are being made to create pressure on the municipality as well. On the other hand, the opposition says that the law is equal for everyone. If there is illegal construction, it is natural to take action. 


Legal aspects 

According to Section 400(1) of the KMC Act, if there is any construction outside the approved design, the municipality can issue a notice and order its demolition. If the owner wants, he can appeal against the notice to the Municipal Building Tribunal. KMC will take further legal action only after the seven-day period ends. 

For now, the focus is on the seven-day deadline. Whether Abhishek Banerjee will go the legal route or the municipality will start the demolition work, it remains to be seen.
