 Reported by Sanchita chatterjee kolkata 7 th May 2026: West Bengal Chief Minister Mamata Banerjee has triggered an unprecedented constitutional standoff by refusing to resign following the All India Trinamool Congress defeat in the 2026 state assembly elections. In a defiant press conference, Banerjee declared, "No question of me resigning... we were defeated not by public mandate but by conspiracy," specifically pointing to the Election Commission of India rather than her political rivals. 

 Mamata Banerjee explicitly stated that her fight was against the Election Commission of India, which she accused of acting in a highly biased manner and altering the outcome through systemic manipulation.


Refusal to Visit Raj Bhavan: She stated, "I will not go to Raj Bhavan" to submit her resignation, challenging the authorities to take action under existing constitutional norms.

The declaration came after the Bharatiya Janata Party secured a clear majority with 207 seats in the 294-member assembly, while the TMC dropped significantly to 

Convention vs. Requirement: While submitting a resignation letter after losing an election is a deeply ingrained constitutional convention, it is not an explicitly written law.


Automatic Expiry The term of the 17th West Bengal Legislative Assembly concluded on May 7, 2026. Under Article 172 of the Indian Constitution, the assembly's tenure automatically expires, stripping any non-returned member of their legal status.

 Because the BJP holds a proven majority, the Governor maintains the absolute constitutional mandate to dismiss the incumbent Council of Ministers and invite the winning party to form a new government.
